Welcome to Rosslyn Beauty. Rosslyn Beauty is the online store operated by the holder of ABN 23 867 193 014. In these Terms of Service, “Rosslyn Beauty”, “we”, “us” and “our” refer to the operator of the Rosslyn Beauty online store.
These Terms of Service (“Terms”) govern your access to and use of https://rosslynbeauty.com.au, including any information, features, products and services made available through the website (collectively, the “Services”). Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services.
By accessing or using the Services, or by placing an order, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, you must not use the Services. These Terms should be read together with our Shipping Policy, Refund Policy and any other policy or terms displayed at checkout.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or protection that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
SECTION 1 — ELIGIBILITY AND USE OF THE SERVICES
You must be at least 18 years old and have legal capacity to enter into a binding agreement, or use the Services with the permission and supervision of a parent or legal guardian.
You may use the Services only for lawful purposes and in accordance with these Terms. If you create an account or provide information when placing an order, you must provide information that is accurate, current and complete.
You are responsible for keeping your account credentials confidential and for activity carried out through your account, except to the extent that activity results from our act or omission. Please notify us promptly if you believe your account has been accessed without authorisation.
SECTION 2 — PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, images, prices and other information are accurate. However, colours and appearance may vary slightly depending on your screen, device settings, lighting and production variations.
Measurements, results, time estimates and product images are provided as a general guide unless we expressly state otherwise. Individual results may vary depending on factors such as hair type, condition, technique and use.
We may update product descriptions, packaging or specifications where reasonably necessary, provided that the product supplied remains materially consistent with the description accepted when you placed your order. We may discontinue products or limit quantities for legitimate business reasons, including stock availability and fraud prevention.
SECTION 3 — SAFE AND APPROPRIATE PRODUCT USE
You must read and follow all instructions, warnings and safety information supplied with a product and use it only for its intended purpose. Do not use a product if it appears damaged, defective or unsafe. Stop using it immediately and contact us if a safety issue arises.
Product information on the website is general information only and is not medical, health or professional advice. If you have a medical condition, sensitivity or concern that may affect whether a product is suitable for you, seek advice from an appropriately qualified professional before use.
Nothing in this section limits your rights under the Australian Consumer Law.
SECTION 4 — ORDERS AND CONTRACT FORMATION
When you submit an order, you make an offer to purchase the products in your cart on these Terms. An automated order confirmation acknowledges that we received your order but does not by itself mean that we have accepted it.
We accept your order when we send you a dispatch confirmation, unless we expressly confirm acceptance earlier. Payment may be authorised or collected before acceptance. If we decline or cancel an order after payment has been collected, we will refund the affected amount to the original payment method.
We may decline or cancel an order for a legitimate reason, including unavailable stock, an obvious pricing or product-information error, suspected fraud or unauthorised payment, breach of purchase limits, an undeliverable address, or a destination we do not service. We will notify you using the contact details supplied with the order.
Products are offered for personal or household use unless we agree otherwise in writing. We may reasonably limit order quantities to prevent unauthorised resale or misuse of promotions.
SECTION 5 — PRICES, PAYMENT AND PROMOTIONS
All prices are displayed in Australian dollars (AUD) unless stated otherwise. The total amount payable, including any applicable taxes, delivery charges or mandatory fees, will be shown before you complete checkout.
Prices may change without notice, but a change will not affect an order we have already accepted, except where the displayed price was an obvious error and the law allows us to correct it. If we identify an obvious pricing error before acceptance, we may contact you to offer the correct price or cancel and refund the order.
You must provide accurate and authorised payment information. Payment services may be provided by third parties and may be subject to their own terms and privacy practices.
Discounts, promotional codes and special offers may have additional conditions. Unless stated otherwise, they cannot be combined, exchanged for cash or applied retrospectively. We may cancel or correct a promotion where there is an obvious error, fraud or misuse, subject to applicable law.
SECTION 6 — SHIPPING AND DELIVERY
We currently deliver only to addresses within Australia. International shipping is not currently available.
Orders are generally processed within 1–3 business days after payment confirmation, excluding weekends and public holidays. Free standard tracked shipping is currently available within Australia, with an estimated delivery time of 8–15 business days after processing and dispatch.
Delivery dates are estimates and may be affected by carrier operations, weather, peak periods and other circumstances outside our reasonable control. We will not treat an estimated date as a guaranteed delivery date unless we expressly agree otherwise. This does not remove any right or remedy available to you under the Australian Consumer Law where delivery is unreasonably delayed or does not occur.
Risk in a product passes to you when it is delivered to the shipping address, an authorised recipient, or a safe location nominated or authorised by you. Title passes when we have received full payment. Nothing in this clause limits any responsibility we have under applicable law for loss or damage occurring before delivery.

SECTION 7 — SHIPPING ADDRESSES, CHANGES AND CANCELLATIONS
You are responsible for providing a complete and accurate shipping address. Please check your order details carefully before submitting your order.
You may request an address change or cancellation before the order has been processed and dispatched by emailing help@rosslynbeauty.com.au as soon as possible and including your order number. We will make reasonable efforts to assist, but we cannot guarantee a change or cancellation once processing has begun.
After dispatch, we may be unable to change the address or cancel the shipment. If a parcel is returned because you supplied an incorrect or incomplete address, or because delivery could not be completed for reasons within your control, we may require payment of reasonable reshipping costs. This does not apply where the issue was caused by us, the carrier, or another circumstance for which you are not responsible.
SECTION 8 — RETURNS, REFUNDS AND CONSUMER GUARANTEES
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, if a product does not comply with those guarantees, you may be entitled to a repair, replacement, refund, cancellation or compensation for reasonably foreseeable loss or damage.
For a major failure, you may be entitled to choose a refund or replacement. For a failure that is not major, we may be entitled to provide a remedy within a reasonable time. Your rights under the Australian Consumer Law may continue beyond any voluntary guarantee period.
Rosslyn Beauty also offers a 30-day money-back guarantee, subject to the conditions in our Refund Policy. This voluntary guarantee is additional to, and does not replace or limit, your rights under the Australian Consumer Law.

Unless our Refund Policy instructs otherwise, contact help@rosslynbeauty.com.au before sending a return so that we can provide the correct instructions. Do not send returns to an address without our prior confirmation.
SECTION 9 — ACCURACY, ERRORS AND AVAILABILITY
Occasionally, the Services may contain a typographical error, inaccuracy or omission relating to a product description, price, promotion, availability, shipping charge or delivery estimate. We may correct information and update the Services at any time.
If an error materially affects an order you submitted, we will act reasonably and in accordance with applicable law. Where appropriate, we will contact you and give you the option to proceed with corrected information or receive a refund for the affected item.
Stock is not reserved until an order is accepted. If a product becomes unavailable after you order it, we will notify you and provide an appropriate refund or alternative option.
SECTION 10 — INTELLECTUAL PROPERTY
The website and its original content, including text, graphics, photographs, videos, layout and design, are owned by or licensed to Rosslyn Beauty and are protected by applicable intellectual property laws.
We grant you a limited, revocable, non-exclusive and non-transferable right to access and use the Services for your personal, non-commercial use. You must not reproduce, distribute, modify, republish, sell, exploit or create derivative works from our content without prior written permission, except where permitted by law.
Third-party names, logos and trade marks displayed through the Services remain the property of their respective owners. No use of a name or logo on the website means that we claim registration or ownership of a third party’s rights.
SECTION 11 — REVIEWS, FEEDBACK AND USER CONTENT
If you submit a review, photograph, comment, suggestion or other content to us (“User Content”), you retain ownership of your User Content. You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that User Content for the purposes of operating, improving and promoting Rosslyn Beauty and the Services, subject to applicable law and our Privacy Policy.
You confirm that you own or have permission to submit the User Content, that it is accurate to the best of your knowledge, and that it does not infringe another person’s rights or contain unlawful, misleading, defamatory, abusive or malicious material. You must disclose any incentive or compensation connected with a review.
We may moderate or remove User Content where reasonably necessary to comply with law, enforce these Terms, protect others, or maintain the integrity of the Services. We will not edit a customer review in a way that materially changes its meaning.
SECTION 12 — THIRD-PARTY SERVICES AND LINKS
The Services may contain links to or integrations with third-party websites, payment providers, delivery providers, social networks or other services. Those third parties may have their own terms and privacy policies.
We are not responsible for third-party content or services that are outside our reasonable control. A link or integration does not necessarily mean that we endorse the third party. You should review the applicable third-party terms before using their services.
Nothing in this section excludes any responsibility we have under applicable law for a third party we engage to perform part of our obligations to you.
SECTION 13 — SHOPIFY’S ROLE
Our store is hosted by Shopify. Shopify provides the ecommerce technology used to make the Services available, but products purchased from the store are sold by Rosslyn Beauty and not by Shopify.
Rosslyn Beauty, and not Shopify, is responsible for accepting and fulfilling your order, providing customer support, and addressing applicable returns, refunds and consumer-law remedies. Nothing in these Terms affects any rights or obligations that cannot be excluded under applicable law.
SECTION 14 — PRIVACY

Because the store is hosted by Shopify and uses third-party service providers, information may be processed by Shopify and other providers as described in our Privacy Policy and their applicable privacy notices.
By using the Services, you acknowledge that you have had an opportunity to read our Privacy Policy. Consent will be requested separately where required by law.
SECTION 15 — PROHIBITED CONDUCT
You must not use the Services to:

We may take reasonable steps to prevent or respond to prohibited conduct, including restricting access, cancelling an affected order or suspending an account. We will act consistently with applicable law and provide any refund required by law.
SECTION 16 — WEBSITE AVAILABILITY AND GENERAL INFORMATION
We aim to keep the Services accurate, secure and available, but we do not guarantee that the website will always be uninterrupted, error-free or compatible with every device. We may temporarily suspend access for maintenance, security, technical or operational reasons.
General content on the website is provided for informational purposes. You should not rely on it as professional advice. Product-specific representations accepted as part of your order and rights under the Australian Consumer Law are not excluded by this section.
SECTION 17 — LIABILITY
Nothing in these Terms excludes, restricts or modifies any liability, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.
To the maximum extent permitted by law, we are not responsible for loss that was not reasonably foreseeable when the contract was formed, or for loss caused by your misuse of a product, breach of these Terms, or failure to follow supplied instructions and warnings.
We are not responsible for a delay or failure caused by an event outside our reasonable control, but we will take reasonable steps to minimise the effect of the event and perform our obligations as soon as reasonably possible. If the delay becomes substantial, you may have cancellation or other rights under applicable law.
Where our liability can lawfully be limited, it is limited only to the extent permitted by law. This section does not limit liability for fraud, wilful misconduct, personal injury caused by negligence, or any other liability that cannot legally be limited.
SECTION 18 — SUSPENSION AND TERMINATION
You may stop using the Services at any time. We may suspend or terminate access where reasonably necessary because of a serious or repeated breach of these Terms, fraud, unlawful conduct, or a security risk.
Termination does not affect rights or obligations that arose before termination. Provisions that by their nature are intended to continue, including those concerning intellectual property, liability, governing law and accrued payment obligations, will survive termination.
SECTION 19 — CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to the Services, our business practices or applicable law. The current version and its effective date will be published on this page.
Changes will apply from the stated effective date and will not retrospectively change the terms of an order we have already accepted unless the change is required by law or you agree to it. Where required by law, we will provide notice of a material change.
SECTION 20 — SEVERABILITY AND WAIVER
If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will be read down to the extent necessary or, if that is not possible, severed. The remaining provisions will continue to apply.
If we delay or fail to enforce a right, that does not mean we waive that right. A waiver is effective only if it is clear and applies only to the specific circumstances for which it is given.
SECTION 21 — ENTIRE AGREEMENT
These Terms, together with the policies and order-specific terms expressly incorporated into them, form the agreement between you and us concerning the Services and your order. If an order-specific term or promotion expressly conflicts with these Terms, the more specific term applies to the extent of the conflict.
Nothing in this section excludes any representation, guarantee or right that cannot lawfully be excluded.
SECTION 22 — GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of New South Wales, Australia, and applicable Commonwealth laws of Australia.
If a dispute arises, please contact us first so that we can try to resolve it promptly and fairly. Nothing in these Terms prevents you from contacting the Australian Competition and Consumer Commission, NSW Fair Trading or another relevant consumer-protection body, or from exercising any right to bring a claim in a court or tribunal with jurisdiction.
You and Rosslyn Beauty submit to the non-exclusive jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them. This does not limit any right you may have to bring a claim elsewhere under applicable law.
SECTION 23 — ELECTRONIC COMMUNICATIONS
You agree that we may send order confirmations, shipping updates, policy notices and other transaction-related communications electronically using the contact details you provide. Marketing communications will be sent only in accordance with applicable law, and you may unsubscribe using the method provided in the message.
